Laketta reserves the right to change these terms and conditions at its sole discretion, at any time. This website provides a service for customers to rent designer dresses and accessories. Through the Services, our aim is to give you access to beautiful designer clothing and accessories, as well as stylist advice and other content to help you choose the perfect items. Definitions: In these Terms of Use, "you" and "your" refer to all users of this Website, and "we," "us," and "our" refer to Laketta.com. References to users also include customers of Laketta.com. LEGALLY BINDING Contract: These Terms of Use constitute a legally binding contract between you and Laketta. These Terms of Use apply to all users, whether browsing or renting products from Laketta. The Terms of Use in effect at any given time are published on the Website, and by accessing or using the Website, you are deemed to have accepted them. If Laketta updates its Terms of Use, the revised terms will supersede the previous ones upon publication on the Website. If you do not agree to the Terms of Use, do not access, use, submit information to, or download from this Website. Specific offerings, incentives, areas, or sections of the Website may also have additional guidelines governing your use of this Website, which must be complied with in addition to these Terms of Use. Rental Agreement: By accessing the Website and ordering products from Laketta, you agree to be bound by our website terms and conditions of use and privacy policy. These are available on our website and are subject to change. You acknowledge that you are renting products from us and that ownership of the product remains with Laketta at all times. Minors may rent products through an adult, who is authorized to rent on their behalf. By clicking the "I accept" rental agreement button, you represent that you are over 18 years of age and authorized to use the payment method provided for the purpose of renting products. Our Commitment to You: We will deliver the ordered product, including the correct size, color, and style, on or before the delivery date specified in your order. In the event that your request is not possible or guaranteed, your order will be amended. Products may appear differently in color and style than they do in images on the Website. Our liability to you for failure to deliver an ordered product is limited to timely delivery. Payment Terms: The rental fee for products will include the rental fee, delivery fees, and any additional charges listed on the Website in relation to your rental. Upon receiving your order, we will charge your payment method for the rental fee and authorize it to charge up to 100% of the original retail value of the product, as listed on the Website, in the event that you do not uphold your obligations under the rental agreement. Product Fit and Returns: If a product does not fit, you may return it unworn within 24 hours for a credit of the rental fee, minus delivery charges. You must email **[dressme@laketta.com](mailto:dressme@laketta.com)** indicating your intention to return the product for credit. Returns for credit will not be accepted if the security tag has been removed from the garment. The term "unworn" will be determined by Laketta and must be met before a credit can be issued. Credits will only be issued if all sizes in the order are unworn. Shipping Information Laketta offers delivery Australia-wide, with shipping methods determined by the company. Deliveries can be made up to 6 PM on the requested day of delivery or earlier, but please note that if the recipient is unavailable to sign for the delivery, it may be taken back to the depot or post office for later collection. It is the recipient's responsibility to ensure they are available for delivery or to collect the item/s. The rental period begins from the time of the courier's first attempted delivery and no credits will be issued for late delivery if the recipient is unavailable to receive it. Dry Cleaning and Product Use Laketta takes great care in dry cleaning and inspecting all products, however, the use of these products is at the recipient's own risk and Laketta cannot be held liable for any health-related issues associated with the product. Please note that these products have been worn by other customers prior to your rental. A prepaid return packaging will be provided with the delivery of your product. Please ensure to place your dress inside the self-addressed envelope and return it to Australia Post by 4 PM on the last day of your rental. Laketta cannot be held responsible for lost articles sent through Australia Post boxes. If you lose the return packaging, it is your responsibility to return the garment via trackable express post to Laketta and provide tracking details to [dressme@laketta.com](mailto:dressme@laketta.com) to avoid further borrowing charges. When returning the dress through an Australia Post Outlet, it will be scanned over the counter as proof of lodgement, and the article will be deemed as returned with responsibility for the article accepted after the first scan. If the dress is returned via an Australia Post Box and is not scanned and lost by Australia Post, the recipient will be responsible for the loss and required to pay the retail cost of the dress minus the rental fee already paid. Once the product is delivered to the nominated address, the recipient bears all responsibility for it. If the recipient opts for delivery to their work address or mailroom, responsibility is passed on as soon as the mailroom signs for the product. A secure shipping address is highly recommended when placing the order, and if an unsecured address is provided, Laketta cannot be held responsible for the product left unattended. If the recipient is unavailable to receive the item, Laketta cannot be held responsible for any additional shipping delays or charges from the delivery service. Treat the product with care and respect, as you would your own belongings. Do not attempt to fit into a dress that is too small or try to zip up a dress that is too tight, as this may damage the zip. The recipient is responsible for any damage to the dress due to fire, major stains, theft, or loss. Normal wear and tear include minor stains, small seam rips, missing beads and sequins, and stuck zippers, but if the product is returned damaged beyond normal wear and tear, the recipient agrees to pay for the cost of repairing the product or, if it cannot be repaired, up to the full retail value of the dress (as listed on the website). The cost will be determined at the discretion of Laketta. Return of Products on Time At Laketta, we require that our customers return their products by 4pm on the order return date (or next business day) using the prepaid return envelope provided. In the event of a late return, a late fee of fifty dollars ($50.00) will be incurred for every day of delay, up to 100% of the retail value of the product as indicated on our website ([www.laketta.com](http://www.laketta.com/)). The late fee will be charged to the payment method provided by the customer and is payable regardless of whether the customer is a member or used credit for their order. If the product is not returned within 20 days of the return date, it will be considered a non-return, and we will charge the customer's payment card the maximum late fee, less any fees already charged. The customer is responsible for purchasing and providing the tracking number for return shipping at their own expense. Laketta is not liable for late or lost products due to the customer's chosen shipping method. Collection In the event of non-payment, we may pass on the outstanding invoices to a collection company, which may result in additional attorney and collection fees. We reserve the right to terminate a customer's right to rent products from us at any time, at our discretion, for breach of this agreement or any other reason. Insurance Normal wear and tear, such as minor stains, rips, missing beads, stuck zippers, or other minor damage, is covered by the insurance fee paid by the customer with their rental of the product. If a product is returned damaged beyond normal wear and tear, the customer agrees to pay for the cost of repair or replacement, as determined by Laketta, up to the retail value of the product. Cancellation Policy Hire fees are non-refundable, but in the event of a cancellation with one week or more notice, we will happily issue a credit note valid for 12 months from the date of cancellation. Email We may use the information from a customer's order to send occasional email marketing, but we will never share any personal details, including the customer's email address, with any other companies or corporations. Customers may opt-out of receiving these emails by emailing [fashionfreedom@laketta.com](mailto:fashionfreedom@laketta.com). Fit In the event that the product does not fit, we will make every effort to send an alternative style or size, subject to availability and courier service availability within the Express network and dependent on confirmation from Australia Post. If an alternative size or style cannot be sent, a merchandise credit will be issued to the customer for the value of the rental. Newsletter We may use a customer's email address to send sales and marketing communications if we have their explicit consent or if they are an existing customer with a legitimate interest. Customers may opt-out of sales and marketing communications at any time, and we will never share or pass along their email address.
